According to the Court of Siracusa (decision dated 17 September 2020), the suspension of the release orders regarding buildings, currently applicable to eviction actions and in force up to 31 December 2020, does not apply to release orders or the transfer decrees regarding real estate buildings subject to seizure proceedings.
In a real estate enforcement procedure, a transfer decree regarding a building was issued by the Court on 4 May 2020. According to the emergency legislation in force due to Covid -19 outbreak, the debtor declared itself not available to release the property until 31 December 2020.
According to the Court, the emergency legislation does not apply to the case issue whilst it applies to eviction proceedings only. The request of the debtor was therefore rejected.
